General Terms of Contract for the Intermediation of Tourist Services

Bespoke Argentina is operated by Leone Viajes, a registered travel agency with a long-standing track record in the tourism sector, member of the Federación Argentina de Empresas de Viajes y Turismo (FAEVYT) and the Asociación Rosarina de Agencias de Viajes (ARAV), Legajo N° 11745. Bespoke Argentina is our expression of that experience: private, tailor-made journeys for international travelers who want to discover the real Argentina, backed by a company that knows it from the inside.

These general terms govern the intermediation of tourist services for the following: air transport, ground transport, accommodation, travel assistance insurance, vehicle rental, and experiences. By making a reservation, the passenger and the retail agency acknowledge full knowledge and acceptance of these conditions.

Definitions

1. Wholesale Agency (Agencia Mayorista): the operator responsible for the tourist services acquired by the passenger, consisting of one or more of the services listed above.

2. Retail Agency (Agencia Minorista): the travel agency through which the passenger acquires tourist services in person or remotely.

3. Provider (Prestador): the party that actually delivers the tourist services — airline, shipping company, vehicle rental company, or other provider chosen by the passenger.

A) Reservations & Payments

1. The wholesale travel agency receives the quotation request and subsequent reservation from the retail agency. The retail agency assumes responsibility for providing complete professional information about all products and services it sells, including travel details and documentation requirements for each destination. Travel agencies act as intermediaries between the passenger and service providers and may use third parties to fulfil their tasks.

2. Payments received before final confirmation are treated as deposits on account. Final confirmation occurs upon full payment in the agreed currency, issuance of tickets and/or service vouchers, and corresponding invoicing.

3. Credit card operations: the passenger must complete payment within the terms established at the time of contracting.

4. Payment links: it is the responsibility of the retail agency to generate payment links (debit/credit card, Mercado Pago®, QR, Pago Fácil® or other methods) and to inform the wholesale operator of payments received so that service vouchers can be correctly issued. If the passenger uses a third party's credit card, it is assumed the cardholder is aware of and consents to the transaction.

5. At the time of quoting, the lowest available fare will be shown, which in general does not permit changes or refunds; at the sole discretion of the provider, changes or refunds may be permitted subject to penalties and/or fare differences.

6. Quotations for services rendered abroad will be in foreign currency (per Res. 4/2025). Payments may be received in pesos at the exchange rate applicable at the time of payment.

B) What Is Included

Services specified in the corresponding itinerary, as informed by providers and wholesale agencies to retail agencies. Round-trip transport where expressly included, with the category stated in the itinerary. Travel assistance where applicable. Accommodation in the hotels stated (or equivalent or higher category in case of substitution), in single, double or triple rooms with private bathroom and taxes included, unless otherwise stated. Meals as indicated. Visits and excursions as stated. Transfers to and from airports, terminals and/or hotels where indicated. Hotel accommodation is calculated from 15:00 on the day of arrival to 12:00 on the day of departure.

C) What Is Not Included

Extras, drinks, meals not specified, laundry, gratuities, personal expenses, excess baggage, telephone calls, boarding taxes, online check-in penalty fees, tolls (unless otherwise stated), VAT and/or other taxes, customs or migration fees, costs related to vaccinations, tests or health requirements for entry to the destination or return to Argentina, seat selection fees, additional baggage fees, optional excursions, museum or attraction entrance fees, local tourism taxes, additional costs caused by transport delays or cancellations, or any service not expressly stated in the service voucher issued by this company. Travel assistance insurance is not included and is strongly recommended for all passengers.

D) Right of Removal

Local operators reserve the right to remove from a tour any passenger whose disruptive conduct, behaviour, health condition or other serious reasons — at the discretion of this company or local providers — endangers or causes disturbance to other travellers or jeopardises the normal operation of the excursion. Passengers are required to act in good faith, with respect for fellow travellers, hotel facilities, transport, and guides at all times.

E) Documentation

It is the exclusive responsibility of the passenger to hold valid personal documentation required by authorities to travel, including for travel with minors. Leone Viajes / Bespoke Argentina assumes no responsibility for deficiencies in documentation, visa processing, passport validity, or travel permits. Passengers without valid travel documents may face cancellation penalties as described in Section F.

F) Cancellations

1. For services contracted in firm, refund requests prior to travel are subject to the contractual conditions of the respective providers. In all cases where refunds are due, the agency will retain documented costs plus a 10% commission on third-party services contracted. Cancellation periods begin from the moment the agency receives written cancellation notice from the email address registered by the traveller. Amounts resulting from cancellation penalties and reservation deposits are non-refundable and may not be applied to future bookings. For air tickets, the conditions of the Air Transport Contract and the fare rules purchased by the passenger apply.

2. For credit operations, amounts paid for administrative costs and interest are non-refundable upon cancellation.

3. Special conditions apply to accommodation, ski resorts, insurance, national and international flights, and charter flights — these will be communicated at the time of contracting.

4. For charter or block-off flights, the conditions established by the carrier apply. Passengers who do not present themselves for boarding (no-show) will lose the full value of the air service.

5. If a minimum group size is not reached, passengers are entitled only to a refund of amounts paid up to the time of notification.

6. Passengers who voluntarily choose not to use contracted services during travel have no right to a refund or compensation.

G) Transport

In cases of cancellation or modification by carriers, only the proportional cost of ground services (accommodation, board, excursions) will be reimbursed where applicable. The agency assumes no responsibility for delays, schedule changes or flight cancellations, which are governed by the Air Transport Contract (Montreal Convention, Law 26.451, Decree 809/2024). Air tickets are valid for one year from the date of issue. Baggage allowances are governed by the fare purchased and the carrier's regulations.

H) Assignment & Transfer

Rights conferred by the tourist services contract may not be assigned or transferred to third parties unless expressly authorised and permitted by provider conditions. Where permitted and involving passengers of different ages, pricing will be adjusted to rates applicable at the time of the request. Leone Viajes / Bespoke Argentina reserves the right to charge an administrative fee of up to 10% of the total trip value for any assignment or transfer.

I) Liability

1. This agency acts as an intermediary in the reservation of tourist services and its liability is determined in accordance with current legislation.

2. This company is not liable for acts of God, force majeure, weather events, pandemics, epidemics, or armed conflict occurring before or during the tour.

3. Passengers are strongly recommended to contract travel assistance insurance appropriate to their age, destination, and duration of travel, covering pandemic contingencies.

4. Personal data contained in travel reservations is treated in accordance with Law 25.326 and will be held for the minimum time necessary. Personal data will only be disclosed to the extent necessary to complete the reserved services.

J) Alterations & Modifications

1. Providers reserve the right to alter all or part of the daily schedule or services for technical, operational or force majeure reasons — including political, epidemic, pandemic, health or migration causes — before or during the tour.

2. Hotels may be substituted with another of equal or higher category within the same urban area at no charge to the passenger, without constituting a breach by the agency.

3. The agency reserves the right to cancel any tour where circumstances make it impossible to deliver the services.

4. Once travel has commenced, voluntary suspension, modification or interruption of services by the passenger for personal reasons gives no right to claim, refund or compensation.

K) Arbitration

Any dispute arising from the formation, fulfilment, breach, extension or termination of this contract may be submitted to the National Consumer Arbitration Service, specifically the Tourist Arbitration Service implemented by Resolution 65/2018 and the consumer protection programme published in the Official Gazette on 8 April 2024, and/or the Arbitration Tribunal of the Federación Argentina de Empresas de Viajes y Turismo (FAEVYT) and/or the Arbitration Tribunals of their respective Regional Associations.

L) Applicable Law

These terms are governed by these general conditions, the Argentine Civil and Commercial Code, and the Consumer Protection Law. In air transport matters, the Aviation Code, the Montreal Convention, Decree 809/2024, and ANAC Resolution 188/2026 apply. All documentation generated for the passenger constitutes the Travel Contract and is confidential information protected by the Personal Data Protection Law 25.326.

M) Acceptance of Terms

Making a travel reservation constitutes full knowledge and acceptance of these General Conditions by both the retail agency and the passenger(s). All services are subject to cancellation and refund conditions established by tour operators, airlines, and government health, migration or political authorities applicable at the time of travel commencement or conclusion.

N) Responsible Traveller Commitment

Bespoke Argentina / Leone Viajes promotes sustainable travel practices to care for the planet, reduce the impact of travel, and support local economies. Our passengers commit to respecting the norms of the UN Tourism Global Code of Ethics for Tourism, available at https://www.unwto.org/global-code-of-ethics-for-tourism. We are committed to child protection policies in tourism.

O) Non-Compliance

In case of genuine divergence between services offered and services contracted, the passenger may appeal to the National Consumer Arbitration Service and/or to the corresponding consumer offices according to their address (cf. Law 25.651).
